We’re often asked if the doctor or hospital will pay medical bills. We have no way of making them pay for medical bills as they’re incurred, but ultimately if a person is successful with their case, a person can recover the cost of their medical care and treatment. That is the reasonable and necessary medical expenses. These include past medical expenses as well as future medical expenses that are more probable than not to be incurred. It is important to note as well that if health insurance or Medicare or Medicaid pays for any of the medical care that resulted from the negligence, they are entitled to be reimbursed. That is an element of what is called economic damages. The liens that are owed to the health insurance companies, Medicare and Medicaid, we are responsible to reimburse those sources for the medical expenses that they have paid.
