Medical malpractice is professional negligence. It’s the failures of a medical care provider, a doctor, nurse, technician, to provide treatment to patients within the applicable standard of care. It’s either doing something a professional of like training wouldn’t do or failing to do something that should be done. A quick example would be if someone goes to the emergency department and they are having shortness of breath, pain in their middle chest that radiates into their arm or jaw, and they are sweating – it sounds like they are having a heart attack. If the medical care provider or the emergency room personnel did not think of that and treat the patient as the emergency that it is, we would say that is medical malpractice.
