One of the major recoverable damages in a medical malpractice case in Florida is, what is typically referred to as pain and suffering, the non-economic damages – someone’s mental anguish for having to live with a significant injury or the death of a loved one. That is that will ultimately a question that will be placed to the jury if a case goes to trial. There is no exact formula for that. Some clients have been more severely injured than others and the jury will ultimately be presented with evidence as to the severity of the person’s injury. It’s our job to be able to communicate that to a jury, as to how this injury has impacted somebody’s life. What is the severity of the injury? How has it impacted their daily life? How has it effected their quality of life?
