Florida doctors are required to carry malpractice insurance. The requirements are woefully inadequate in my judgment. If you are a physician and have staff privileges at a hospital you’re required to have either medical malpractice at a minimum of $250,000 or a letter of credit indicating that you will be able to pay a judgment of up to $250,000. If you’re a physician who doesn’t practice in the hospital, that minimal amount is $100,000. Normally hospitals have great assets or malpractice insurance that far exceeds those minimal limits. It isn’t a problem to collect with hospitals, but with physicians there is often a problem with limited coverage, of getting full compensation for our clients.
